Terms and conditions

EMERGENCY HOTEL REIMBURSEMENT - 

When we are able to get your home cooling during extreme *heat advisories OR in the even that is is *too cold - We will reimburse the homeowner up to $65 per night not to exceed 4 nights. 

1. Homeowner must requesting hotel service and receive an authorization number from ELijah Warranty team prior to checking in to the hotel. 

2.The home's interior temperature must exceed 90 F or be below 55 F.

3. Homeowner must provide original hotel receipt. 

4. Reimbursement check will be mail out within 30 days after invoice has been received.

5. Maximum annual hotel liability is $240.00

TOTAL AGGREGATE LIMIT - 

1. Total aggregate limit is different for each program and is as follows

 - GOOD - Total aggregate limit $765.00 per warrantied unit.

 - BETTER - Total aggregate limit $1305.00 per warrantied unit.

 - BEST - Total aggregate limit $2355.00 per warrantied unit.

1. Office hours are 7:00AM - 4:00PM during summer and 9:00AM - 5:00PM during fall.

2. Service hours are 7:00AM - 7:00PM during summer and 8:00AM - 5:00PM during fall.

3. Elijah Air LLC reserves the right to perform all necessary repairs on warrantied units. Homeowner agrees that if anyone other than the warranting company performs any service on the warrantied units the warranty with us will be VOID. 

4. 29 point inspections are seasonal and much be scheduled accordingly. Fall inspections are done between September and November. Spring inspections are done between February and April.

COVERAGE PERIOD -

This is a 1 year contract agreement. This warranty activates 30 days after first payment and is valid until 30 days after last payment.

BACKGROUND:

The Client is of the opinion that the Contractor has the necessary qualifications, experience and abilities to provide services to the Client.

The Contractor is agreeable to providing such services to the Client on the terms and conditions set out in this Agreement.

IN CONSIDERATION OF the matters described above and of the mutual benefits and obligations set forth in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, the Client and the Contractor (individually the "Party" and collectively the "Parties" to this Agreement) agree as follows:

Services Provided 

The Client hereby agrees to engage the Contractor to provide the Client with the following services (the "Services"):

HVAC warranty, maintenance, repair and/or installation.

The Services will also include any other tasks which the Parties may agree on. The Contractor hereby agrees to provide such Services to the Client.

Term of Agreement

The term of this Agreement (the "Term") will begin on the date of this Agreement and will remain in full force and effect until the completion of the Services, subject to earlier termination as provided in this Agreement. The Term of this Agreement may be extended with the written consent of the Parties.

In the event that either Party wishes to terminate this Agreement prior to the completion of the Services, that Party will be required to provide 10 days' written notice to the other Party.

Performance

The Parties agree to do everything necessary to ensure that the terms of this Agreement take effect.

Currency

Except as otherwise provided in this Agreement, all monetary amounts referred to in this Agreement are in USD (US Dollars).

Any job that requires additional funding pre-ordered parts must pay 25% upon ordering the part. The rest is due upon completion. Warranty time frame is as specified on invoice.

Invoices submitted by the Contractor to the Client are due upon receipt.

The Compensation as stated in this Agreement does not include sales tax, or other applicable duties as may be required by law. Any sales tax and duties required by law will be charged to the Client in addition to the Compensation.

Refunds/ Reimbursement of Expenses

The Contractor will honor the warranty specified on invoice. All sub contracted Home warranty work has a 90 day parts and labor warranty. All Other Work Has A 2 year Labor 1 year Parts Warranty. All sales are final. NO REFUNDS, this is in place for reasonable and necessary expenses incurred by the Contractor in connection with providing the Services. 

In the event that this Agreement is terminated (Monthly Plans Only)

In the event that this Agreement is terminated by the Client prior to completion of the Services the Contractor will be entitled to a $500.00 cancellation fee. Any materials or equipment which is the property of the Contractor or, where agreed between the Parties, to compensation in lieu of recovery.

Capacity/Independent Contractor

The Contractor is responsible for paying, and complying with reporting requirements for, all local, state and federal taxes related to payments made to the Contractor under this Agreement.

Notice

All notices, requests, demands or other communications required or permitted by the terms of this Agreement will be given in writing and delivered to the Parties at the following addresses:

Indemnification

Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party, and its respective affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from or arise out of any act or omission of the indemnifying party, its respective affiliates, officers, agents, employees, and permitted successors and assigns that occurs in connection with this Agreement. This indemnification will survive the termination of this Agreement.

Modification of Agreement

Any amendment or modification of this Agreement or additional obligation assumed by either Party in connection with this Agreement will only be binding if evidenced in writing signed by each Party or an authorized representative of each Party.

Time of the Essence

Time is of the essence in this Agreement. No extension or variation of this Agreement will operate as a waiver of this provision.

Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of Arizona.

Waiver

The waiver by either Party of a breach, default, delay or omission of any of the provisions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.

IN WITNESS WHEREOF the Parties have duly affixed their signatures under hand and seal on this approved Invoice dated the day of the service agreement. Attached Invoice signature is binding to this agreement in full.
